Brightline, a Florida railroad, lost its attempt to delay a union election, when the National Mediation Board ruled that Brightline was subject to the Railway Labor Act. The NMB’s ruling meant that an upcoming election was authorized. The NMB is an independent agency that coordinates labor relations with railroads and airlines. Brightline had argued that it was in fact not a railroad, despite numerous facts to the contrary; it also treated its workers in an unacceptable way, said TWU International President John Samuelsen. The NMB determined that the fact that Brightline was pursuing federal grant money made it subject to the Railway Labor Act.
