New York City is a working people’s city, and the Adams Administration is committed to advancing solutions to provide for some of our most vulnerable neighbors.

All workers deserve to earn fair pay for their labor and the ability to support themselves and their families, but for too long, app-based restaurant delivery workers performed an essential service for our city only to earn far less than the minimum wage and with no benefits or compensation for their expenses.

But that all changed late last month when the State Supreme Court Appellate Division ruled in favor of the city, allowing us to begin enforcement of the Minimum Pay Rate after months of fighting the legal challenges from the delivery apps.

These workers are now making at least $17.96 per hour – a rate that will lift thousands of working New Yorkers and their families out of poverty and help them to afford safer equipment and cover medical expenses.

When the rate takes full effect in 2025, these workers will earn at least $19.96 per hour, nearly three times what they made before the minimum pay rate, and establishing pay equity with other workers who are protected by the minimum wage.

The Department of Consumer and Worker Protection will continue to work with advocacy organizations to conduct outreach and educate workers on their rights. A rising tide lifts all boats, and last month’s win represents a win for all working New Yorkers.

We encourage all delivery workers to visit nyc.gov/DeliveryApps or call 311 and say “delivery worker” to learn more about the new pay rate. Workers can also ask questions or file complaints in multiple languages online or by contacting 311.
