In a major victory for not only the Teamsters but all workers and unions, the NLRB has handed down a decision in the case of Teamsters v. Cemex Construction Materials Pacific, LLC. The win has vital implications since it concerns union-busting attempts as they relate to union elections. Because Cemex committed egregious labor law violations that could compromise the legitimacy of the results of an election, the NLRB says that now, as a result, the company must bargain with the Teamsters. This sets a precedent for all other such situations, showing that this type of interference can only lead to a loss of power for the employer. Chris Griswold, Teamsters International Vice President At-Large and President of Teamsters Joint Council 42, said that Cemex had fired union supporters, intimidated them, harassed them, and compared the company’s attempts to influence elections to “a tin-pot dictatorship.”
